Court records may also help individuals better understand a legal matter when combined with other public records (arrest, property, vital, etc.) maintained by county or state departments.

Are Blount County Court Records Public?

Yes. Members of the public may access Blount County court records in line with provisions made in the Tennessee Public Records Act and court rules, such as Supreme Court Rule 34. The Public Records Act and the court rule establish a presumption that government and court records should be open to residents.

However, access to court records is not absolute. In certain cases, some records or information are kept confidential, especially details that reveal sensitive information or that directly identify vulnerable populations. Such records include

  • Online Access

Online portals are typically the fastest way to find basic case information in Blount County. Individuals may use the Blount County Online Court Records Search portal to view cases filed in the county from August 1, 2019, to present. A search can be made by party name or by case year and case number. Confidential records and records filed before August 1, 2019, may not be viewable on the portal.

  • In-Person Access

Individuals seeking access to records filed before August 1, 2019, or confidential records may visit the appropriate courthouse. Inquirers may inspect records on the public terminals and search for records free of charge by party name or case number. Also, individuals may fill out and submit the Public Records Request, Form A, to the Circuit Court Clerk’s Office (for records maintained by the Circuit Clerk).

Requesters may be asked to provide proof of Tennessee citizenship, as the right to inspect and receive copies of a government record under the Public Records Act is for citizens. Disclosure of a record to a non-citizen is considered discretionary.

  • Mail and Phone Requests

To obtain copies of a court record in the county by mail, individuals may mail a written request or, ideally, a completed Public Records Request, Form A (for Circuit Court records). If sending a written request, individuals should ensure that they adequately describe the record and include at least the names of the parties involved or the case number. Requesters may be asked to pay the fees for the record in advance if the total cost exceeds $25.

Fees for Court Records in Blount County

In Blount County, there is generally no charge to inspect public court records in person or online. However, if physical or digital copies of the record are required, a fee may apply. Below is the court record fee schedule for the county.

  • Standard photocopies: 50 cents per page
  • Certified copies: $5 per document
  • Exemplified copies: $10 per document

There are also labor fees that may be charged if the request is complex and requires a significant amount of time to fulfill. Also, if the record is requested on a digital medium (CD, DVD, or flash drive), the requester will have to pay the actual cost of the device.

Criminal Records Access in Blount County

Criminal records in Blount County are split between court case files and official criminal history reports.

Court case files are local records that document specific interactions with the Blount County justice system. These records may be maintained by the General Sessions Court or the Circuit Court. Older records are usually kept with the Blount County Records Management and Archives Department. Individuals may search active records online or by visiting the court during its hours, or contact the Records Management Department for archived records.

Official criminal history reports in Blount County are not processed by the courts, but by the Tennessee Bureau of Investigation (TBI), which is the central repository for all criminal history in the state. Members of the public can perform an open records check (name-based) on any individual using the Tennessee Open Records Information Services. The cost for a check is $29, and it is non-refundable. Fingerprint-based checks are also available, but these are limited to the subject of the record and authorized agencies or employers.

Blount County Probate Records

Blount County probate records are legal documents that detail the administration and settlement of a deceased person’s estate. These records usually contain wills, inventories of assets, petitions for probate claims against the estate, and final settlements.

Probate records are broadly considered public records in Blount County. However, some documents filed with the court during probate contain sensitive information and are usually not disclosed (either in their entirety or in part) to the public. Examples are wills filed before probate and financial account numbers.

The Blount County Clerk and Master’s Office within the Chancery Court is responsible for all probate matters in the county. Federal court records are not handled by any of the local Blount County clerks, but by the United States District Court for the Eastern District of Tennessee, specifically the Northern Division. Federal court records are also accessed through a different system than the local Blount County search tools.
